Default Owner


If you code a website but outsource some of it who owns the code.

I know many people will have agreements with the person who they outsourced to give them full rights but if you dont who owns the code.

And what are the implications if it isnt you, can they take it back from you or sell your secrets to someone else?

Depends on what you agreed. If you paid for the work, it becomes your work.

Yes, if you contracted the work out, you should have a clause in the contract (or something in writing anyway) that shows the contractor agrees that they give up all rights to the code.

Of course, I'm not a coder so I don't know how coders would react to this. Would they be reluctant to give up the rights to a real cool tool they developed or something along those lines? I'm not so sure, especially if they think it could be used commercially. Maybe you'd have a hard time finding someone to help you with such a process.

Any coders out there who would like to help out in this discussion?

It all depends on the contract that you have in place like everyone has said. If you have no contract then normally it's the rights of the person who created it and not the person who bought it.

It depends on the contract you have with the other party. If you outsource "some" of the work I doubt the party would want to have rights to the code they create. Basically you need to have an understandment with the other party on who owns the code.
