Default How are my terms of service?

I have never written a TOS and need to know if the protect myself.

Also just by having a link to them does it mean a user agrees to them or do I need to put "by downloading/purchasing a theme you agree to the terms or service" on download/purchase pages.

The Terms of Service is good enough. It's not very legal and I'm sure there are some loopholes, but TOS are ridiculous difficult to enforce over the Internet, so unless you want to spend time getting a lawyer to write you up one then what you have it fine. However, you will need to display the TOS as well as a checkbox for purchasers of your skins to click on. Remember, you have to have the TOS visible on the page for it to be legitimate and hold up in court.

It wouldn't be for court. Mainly if someone issues a paypal chargeback I can say check out #4 in my TOS, it clearly states he is in the wrong.

You won't win a PayPal chargeback unless you send them a physical good and you have proof that you did so. That's just how PayPal works. A good Terms of Service won't help you there.

Yep thats true. I have read about people buying "virtual goods" and being ripped off, Paypal will not help you there at all.
