I guess its safe to say a contract is a legal binding that sometimes if has the right guidelines makes us all feel safe. But it is true... you COULD put in the contract your require payment in increments. For me, I'd put 25% before, 25% MS2 (our of a 4 MileStone guide) and lastly 50% after the full job is done (but BEFORE you send the finished product.)

What if the employer won't abide by the contract? How can we assert our rights if we are very far from each other?

That's where your deposit, refusal to submit final work, and professional organizations you belong to come in. The deposit ensures you get something. Never submit final work until at least your second payment comes in (or work hourly with weekly paydays). If they still don't pay, check with professional organizations to whom you belong to see if they offer any sort of assistance.

Beyond that, get mean and threaten. If it's enough money, talk to a lawyer.

If you're in different countries, enforcing a contract is going to be near impossible. You might consider using a site like rentacoder.com who will be an intermediate between you and your clients.

I have to disagree ed, you can still enforce a contract through multiple ways. As I said, you can do it with the signature of the client and a notary. They can send you via mail the contract back.

Now before questioning the fact of "what if they forge a notary's signature" then anybody would tell you that forging a signature is against the law here in the U.S. If my mind serves me right, its a felony and if feline sues them, they'd have 2 charges against them. Failure to pay and forging a notarized signature.

But then again, if you are suing a company from another country in which your business was strictly online, wouldn't they face justice in their country instead?

Well, I can't really comment on that, but you have to figure, their facing justice anywhere, each country should atleast have a law abiding that forging a signature is against the law... I may be wrong, but if not, then hey... you still have all right to sue that person in their country if they forged a false and undocumented signature.

Yeah, I just got permantly bannede from Rent A Coder (they explain that it is recommended to ask about alternate payment methods to the client in which will earn the freelancer more money and save RAC other charges.) So I did so and then they say its against the guidelines, RAC is garbage if you ask me.

Freelancers will be only on a safeside if they sign in a service aggrement and should have sufficient proofs.
