Default T & C and Privacy Policy


Do you have to display terms and conditions and privacy policies as soon as you start to trade from a site, or can these be added at a later date?

If you are accepting money, taking information, etc - you should have these policies in effect. Some merchant account providers demand the policies in place so they know what you expect from your customers and to make sure they are in compliance with Visa and MasterCard

As Corey mentions, most processors/merchant (if not all, legitimate processors) will require such. They're really not that difficult to come up with though and in the end protect you and your customer. I just suggest you take a look at a few of your competitors terms and come up with something that makes sense for your business, provides the sufficient protections you need to be conscious of, and so fourth. Additionally you need to provide refund/cancellation policies for customers so that they're on the same page.

Oh...and you may want to run it all past an attorney....

It depends on the country you are located in as well also. You should always have the policies in place to protect yourself and your customers, and they should be available so that everyone knows what the policy is ahead of time.

In your best interest you need to have them up before you start doing business. If something goes wrong it's that clause that protects you from being sued and keeps your business running. It's important that your customers know what they are agreeing to when they do business with you. If you plan to do serious business it would be best to draft it up and buy an hour or two with a lawyer and go over it with him.
