Default Trademarks


I was looking around on the USPTO website and started looking into trademarks. I must admit, it is tempting to think I can legally restrict use or duplication of my company name simple by trademarking. So I started to look into it and ran into 1 or 2 nags.

They are:

1. If I trademark the name for the U.S.A. -- wouldn't I need to trademark in other companies if I wanted to keep from people using the same name?

2. Would it just reserve my name for my niche/commerce category or entirely nobody can use it?

3. Is it smart to do for $375?

I am going to look into it more and then do a blog on it later of trademarks so this'll help me debate what to blog on it about.

BTW... will this keep me from personally being liable (sort of like an LLC) if my business is ever sued, my personal assets are safe, or would I need to get an LLC at the same time.

Have you looked directly on the government's site for the exact details of trademark protection.

I imagine you could do it yourself for far less than $375.

Trademarking, to my knowledge, won't protect your personal assets. You'll have to set up the LLC for that.

$375 is the cost to file a Trademark on your own, its the government price for a trademark.

I can confirm that it is true. Trademark is only to protect the companies identity. Such as my name, if you wanted to start a company called LogicTech for example... and nobody else had the name registered as a trademark, then you could register it as a trademark and nobody else could use it (you have to do trademarking seperately for each country... $375 just protects you from having your name stolen in the USA, you still have Australia, Europe, Asia, China, Africa and South America I BELIEVE to trademark through.)

LLC keeps the business owners personal assets safe.

http://www.legalzoom.com --- maybe that'll help you out there for your seeking pleasure eldo (they do the filing for that type of stuff for an additional fee.)
